From Immigration Hold in Corpus Christi to Home in Dallas — Within Two Weeks!

Mr. L was born in Mexico, but when he was age 15 his father passed the naturalization exam and became a U.S. citizen. This summer however, Mr. drove from his home in Dallas, Texas, to Corpus Christi, Texas, for work reasons. A traffic stop landed him in jail with an “immigration hold”. His family in Dallas hired Rodriguez & Moretzsohn to help. An attorney visited Mr. L in jail and advised him in Spanish to not sign any Voluntary Departure (¡No firmar una salida voluntaria!). Next the family paid the county bond, and Mr. L was turned over to ICE. We then asked ICE to release Mr. L because, per INA § 320(a), he has a claim for automatic acquisition of U.S. citizenship. ICE granted our request and issued an Order of Release on Recognizance (ORR), which means Mr. L was set free without having to pay any ICE bond at all. Within two weeks Mr. L was back in Dallas with his family!
