PERM certified without any audit!

USCIS granted to Mr. S of Mexico a nonimmigrant visa to work for a company in the United States, as a horse trainer for polo matches. The company then hired Rodriguez & Moretzsohn, PLLC, for help with the Program Electronic Review Management (PERM). PERM certification means an employer has tested the job market and the Department of Labor (DOL) agrees that there
are no qualified and willing U.S. workers. When the DOL audits a PERM case, the processing time can be over a year.

In the case of our horse trainer, the DOL certified the company's PERM without any audit! The company now has a six-month deadline to petition for an immigrant visa for Mr. S.

Set Free from ICE — for Free!

Mr. C of Guatemala entered the U.S. without inspection, was arrested and the U.S. Marshals detained him as a material witness. Mr. C’s aunt in Los Angeles, California, consulted by telephone with attorney Debra Rodriguez, who is Board Certified in Immigration and Nationality Law by the Texas Board of Legal Specialization.

First, we advised the attorney appointed by the federal court to represent Mr. C. Then, once ICE took custody of Mr. C and moved him to the Joe Corley Detention Facility in Conroe, Texas, we helped him request a credible fear interview. If returned to Guatemala, Mr. C feared the smuggler (coyote) would threaten him or his family.

After about 6-7 weeks of waiting, Mr. C passed the credible fear interview. We then asked the deportation officer to release Mr. C under an Order of Release on Recognizance or, if necessary, under a low bond. The officer granted our request, without requiring any bond money! Mr. C was released and traveled by bus to a relative in Idaho, to await a date to appear in the Immigration Court. Mr. C knows that he must formally apply for asylum (Form I-589) within one year of entering the U.S.

From Immigration Hold in Corpus Christi to Home in Dallas — Within Two Weeks!

Mr. L was born in Mexico, but when he was age 15 his father passed the naturalization exam and became a U.S. citizen. This summer however, Mr. drove from his home in Dallas, Texas, to Corpus Christi, Texas, for work reasons. A traffic stop landed him in jail with an “immigration hold”. His family in Dallas hired Rodriguez & Moretzsohn to help. An attorney visited Mr. L in jail and advised him in Spanish to not sign any Voluntary Departure (¡No firmar una salida voluntaria!). Next the family paid the county bond, and Mr. L was turned over to ICE. We then asked ICE to release Mr. L because, per INA § 320(a), he has a claim for automatic acquisition of U.S. citizenship. ICE granted our request and issued an Order of Release on Recognizance (ORR), which means Mr. L was set free without having to pay any ICE bond at all. Within two weeks Mr. L was back in Dallas with his family!

Son Rescued From ICE Airplane

Mr. F of Guatemala entered the United States illegally. After ICE arrested him, he was detained at the Coastal Bend Detention Center in Robstown, Texas. His mother in Oakland, California, called and hired Rodriguez & Moretzsohn, so a Spanish-speaking experienced immigration attorney visited Mr. F face-to-face on July 3, 2013.

July 4, 2013, was Independence Day.

July 5, 2013, a Friday, in the morning, we called and a deportation officer told us Mr. F was boarding an airplane bound for Guatemala. We explained that Mr. F fears persecution. Minutes before the plane took off, even though it was already late, we persuaded the officer to pull Mr. F off the airplane!

Hijo Rescatado De Un Avión De ICE

Sr. F de Guatemala entró a los Estados Unidos ilegalmente. Después de que ICE lo arrestó, fue detenido en el Coastal Bend Centro de Detención en Robstown, Texas. Su madre en Oakland, California, llamó y contrató a Rodriguez & Moretzsohn, así es que un abogado de habla hispana con experiencia en casos de inmigración visitó al Sr. F cara a cara el 3 de julio de 2013.

El 4 de julio de 2013 fue el Día de Independencia.

El viernes 5 de julio de 2013, en la mañana, llamamos y un oficial de deportación nos dijo que Sr. F estuvo abordándose a un avión con destino a Guatemala. Explicamos que Sr. F teme persecución. Minutos antes de que se fuera el avión, aunque el vuelo ya estaba atrasado, ¡persuadimos el oficial para que baje Sr. F del avión!

Woman Granted Green Card After Waiting 20 Years

CORPUS CHRISTI, TX – In 1993, a permanent resident filed a visa petition (I-130) for her daughter, Ms. R, who moved from Mexico to Texas in 1999. In 2010, ICE arrested Ms. R, and she hired Rodriguez & Moretzsohn. The deportation defense strategy changed in 2013 when the Visa Bulletin showed the I-130 priority date was current. Rodriguez & Moretzsohn helped Ms. R apply for a green card. At her trial in the Immigration Court in Harlingen, TX, the judge approved the adjustment for Ms. R – after waiting 20 long years!
